Recently, a system prompt suspected to be Claude was accidentally leaked, which attracted the attention of many netizens and programmers.

What are AI's system prompts? Suppose you want AI to play the role of a customer service representative. The system prompts are equivalent to telling AI in advance that "you need to play the role of a professional and friendly customer service representative, be patient and polite when answering customer questions, and ask customers to evaluate your performance after each answer." System prompts are the behavioral framework and instructions preset by the model developer for AI. It can be simply understood as telling AI what it should and should not do in advance.

The accidentally leaked Claude system prompts are about 25,000 tokens long and very detailed, covering Claude's role and interactive style design, copyright and ethical constraints, content security filtering, tool selection strategies, etc. Although Claude has its own officially released system prompts, everyone thinks that this leaked version is the real prompt of Claude (dog head)

In theory, it is not difficult to crack the prompt words of the artificial intelligence system. Recently, a blogger posted online that he used the following prompt words to easily crack the system prompt words of NotebookLM.

Recently, a developer uploaded a project on Github, exposing the system prompts and internal configurations of AI tools such as Cursor and Windsurf.

Can it be protected by trade secrets?

A system prompt with rich content and detailed description of the model can often reflect the design intent, product positioning and value orientation of the model developer, which is undoubtedly very important to the model developer.

But if such a system prompt word is cracked by others through a prompt word attack, does an AI company have legal means to protect its rights and interests? For example, does the AI ​​system prompt word constitute a trade secret?

According to the definition of trade secrets in my country's Anti-Unfair Competition Law, trade secrets refer to commercial information such as technical information, business information, etc. that is not known to the public, has commercial value and for which the right holder has taken corresponding confidentiality measures.

We analyze whether the AI ​​system prompt words constitute trade secrets based on the three characteristics of trade secrets:

Secrecy

If the confidentiality requirement of a trade secret is to be met, the relevant information must not be known to the public, and must not be generally known or easily obtained by relevant personnel in the AI ​​field, that is, the requirement of not being known to the public. However, as we mentioned earlier, the Claude system prompt word leak, as well as a large number of cases where the system prompt words of the AI ​​model are obtained based on simple prompt words, it seems that the AI ​​system prompt words are relatively easy to be obtained or known by the public. Therefore, whether the system prompt words meet the confidentiality requirement still needs further discussion.

The plaintiff, OpenEvidence, is an AI medical information platform with a valuation of $1 billion that provides AI question-answering and other services for use by medical professionals and patients. The plaintiff accused the defendant of using system prompts and instruction sets obtained from OpenEvidence to develop a platform that directly competes with OpenEvidence.

The plaintiff claimed that it had taken a variety of measures to protect the system prompt words, such as limiting platform access rights, requiring users to register, prohibiting bypassing technical protection measures or reverse engineering, etc. The plaintiff believes that the system prompt words are the company's core assets, which determine the behavior and response of the model, have extremely high commercial value, and are not known to the public. The plaintiff accused the defendant of obtaining the system prompt words of the plaintiff's platform through prompt word attacks and illegal access, in violation of the U.S. Defend Trade Secrets Act. In addition, the plaintiff also claimed that the defendant constituted unfair competition and violated the Digital Millennium Copyright Act.
