1. What is algorithm filing? Under what circumstances is algorithm filing ?


According to the "Internet Information Service Algorithm Recommendation Management Regulations", algorithm recommendation service providers with public opinion attributes or social mobilization capabilities need to register their algorithms.


Specifically, providers of information services such as forums, blogs, microblogs, chat rooms, communication groups, public accounts, short videos, live broadcasts, information sharing, mini-programs, or other Internet information service providers that provide channels for the expression of public opinion or have the ability to mobilize the public to engage in specific activities need to register algorithms.



The types of algorithms that need to be registered mainly include generation and synthesis, personalized push, sorting and selection, retrieval and filtering, scheduling and decision-making, and other algorithm technologies.



 

Provisions on Security Assessment of Internet Information Services with Public Opinion Attributes or Social Mobilization Capabilities

Article 2 Internet information services with public opinion attributes or social mobilization capabilities as referred to in these Regulations include the following situations:
(1) Opening forums, blogs, microblogs, chat rooms, communication groups, public accounts, short videos, live webcasts, information sharing, mini-programs and other information services or providing corresponding functions;
(2) Establishing other Internet information services that provide channels for the expression of public opinion or have the ability to mobilize the public to engage in specific activities.
Regulations on the Administration of Internet Information Service Algorithm Recommendations
Article 2 These Regulations shall apply to the provision of Internet information services using algorithm recommendation technology within the territory of the People's Republic of China (hereinafter referred to as algorithm recommendation services). Where laws and administrative regulations provide otherwise, such provisions shall prevail. The application of algorithm recommendation technology as mentioned in the preceding paragraph refers to the use of algorithm technologies such as generation and synthesis, personalized push, sorting and selection, retrieval and filtering, and scheduling and decision-making to provide information to users.
Regulations on the Administration of Internet Information Service Algorithm Recommendations

Article 24: Algorithm recommendation service providers with public opinion attributes or social mobilization capabilities shall complete registration procedures within ten working days from the date of providing services by filling in the name of the service provider, service form, application field, algorithm type, algorithm self-assessment report, proposed public content and other information through the Internet Information Service Algorithm Registration System.

If the registration information of an algorithm recommendation service provider changes, the change procedures must be completed within ten working days from the date of the change.

If the algorithm recommendation service provider terminates the service, it shall go through the cancellation registration procedures and make appropriate arrangements within twenty working days from the date of termination of service.

Interim Measures for the Administration of Generative Artificial Intelligence Services

Article 17: Providing generative AI services with public opinion attributes or social mobilization capabilities shall conduct security assessments in accordance with relevant national regulations and perform algorithm filing and change and cancellation filing procedures in accordance with the "Internet Information Service Algorithm Recommendation Management Regulations."


2. What is the online filing of large models?


According to the requirements of the Interim Measures for the Administration of Generative Artificial Intelligence Services, generative artificial intelligence services with public opinion attributes or social mobilization capabilities can be registered through the local cybersecurity and informatization departments, and the National Cyberspace Administration of China will regularly summarize and publish them. The online registration of large models requires the submission of application forms, security self-assessment reports, corpus annotation rules, keyword interception lists, evaluation test question sets and other materials.




 

3. What is large model registration? Under what circumstances is large model registration required?


According to the notifications of local Internet Information Offices, services can be provided online directly by directly calling registered large model capabilities through API interfaces or other means, and providing generative artificial intelligence services with public opinion attributes or social mobilization capabilities to the domestic public , subject to the compliance with relevant national laws and regulations, and after approval by the provincial Internet Information Office and issuance of an online number .



 

For example, according to the notice of the Guangdong Provincial Cyberspace Administration : registration work will be carried out for generative artificial intelligence services that directly call registered large model capabilities through API interfaces or other means, and provide public opinion attributes or social mobilization capabilities to the domestic public.


4. How much subsidy can be obtained after the algorithm is registered?


Taking Guangzhou Haizhu District as an example, according to the "Implementation Rules for the Construction of Artificial Intelligence Large Model Application Demonstration Zone in Guangzhou Haizhu District", algorithm filing can obtain a series of subsidies:



( 1) Large model enterprises that complete the online filing of national-level generative artificial intelligence (large language model) for the first time will be given a one-time reward of up to RMB 1 million.



( 2) Large model enterprises that complete the national-level domestic Internet information service algorithm registration or deep synthesis service algorithm registration for the first time will be given a one-time reward of up to 200,000 yuan.



 


5. What are the consequences of not filing an algorithm?


Enterprises or service providers that fail to file algorithms in accordance with the law will face a series of serious consequences, including:



( 1) Failure to file a record when required: warning, criticism, and order to make corrections within a time limit; if corrections are refused or the circumstances are serious, the information update will be suspended and a fine of RMB 10,000 to 100,000 will be imposed. If the act constitutes a violation of public security management, public security management punishment will be imposed in accordance with the law; if the act constitutes a crime, criminal liability will be pursued in accordance with the law;



( 2) Where a person obtains a record through improper means such as concealing relevant circumstances or providing false materials: the record will be revoked, and the person will be given a warning or criticized in a circular; if the circumstances are serious, the person will be ordered to suspend information updates and be fined RMB 10,000 to RMB 100,000;



( 3) If the service is terminated but the cancellation registration procedures are not completed: cancellation registration;



( 4) If a serious violation of the law is committed and an administrative penalty is imposed, such as an order to close the website, revoke the relevant business license or revoke the business license: cancellation of registration.


Regulations on the Administration of Internet Information Service Algorithm Recommendations

Article 31 Where algorithm recommendation service providers violate Article 7, Article 8, Article 9, paragraph 1, Article 10, Article 14, Article 16, Article 17, Article 22, Article 24, and Article 26 of these Regulations, and there are provisions in laws and administrative regulations, such provisions shall apply; where there are no provisions in laws and administrative regulations, the cybersecurity and informatization departments and telecommunications, public security, market supervision and other relevant departments shall give warnings, issue notices of criticism, and order rectification within a time limit; where rectification is refused or the circumstances are serious, the information update shall be suspended and a fine of not less than RMB 10,000 but not more than RMB 100,000 shall be imposed. Where such acts constitute violations of public security management, public security management penalties shall be imposed in accordance with the law; where such acts constitute crimes, criminal liability shall be investigated in accordance with the law.

Regulations on the Administration of Internet Information Service Algorithm Recommendations

Article 33: Where algorithm recommendation service providers with public opinion attributes or social mobilization capabilities obtain registration through improper means such as concealing relevant circumstances or providing false materials, the national and provincial, autonomous region, and municipal cyberspace administration departments shall revoke their registration, give warnings, and issue criticism; where the circumstances are serious, they shall be ordered to suspend information updates and fined between RMB 10,000 and RMB 100,000.



 

6. If I access a registered large model but make fine-tuning or add new training corpus, can I just register the large model?



If an enterprise makes fine-tuning to the registered big model, or adds new corpus for training, there is a possibility of affecting content security and other aspects, and therefore may not meet the big model registration requirements.
